1. Acceptance of Terms

By accessing, registering for, or using Nairobi Elite ("the Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must immediately cease all use of the Platform.

2. Eligibility & Age Requirements

2.1 Age Verification

• By creating an account, you expressly represent and warrant that you are 18 years of age or older
• We reserve the right to request age verification documentation at any time
• Failure to provide satisfactory proof of age within 48 hours of request will result in immediate account suspension
• We may use third-party age verification services to confirm your identity and age

2.2 Prohibition on Minors

• Individuals under 18 years of age are strictly prohibited from registering, accessing, or using the Platform
• Parents or guardians may not create accounts on behalf of minors
• Users may not facilitate minor access to the Platform through their account
• Any account found to be operated by or for a minor will be permanently terminated
• We actively cooperate with law enforcement regarding any suspected minor activity

2.3 Legal Capacity

You must have the legal capacity to enter into binding contracts in your jurisdiction. By using the Platform, you represent that you are not prohibited from receiving services under the laws of your country or jurisdiction.

3. Account Registration

3.1 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You must immediately notify us of any unauthorized use of your account
• You may not share, sell, or transfer your account to any other person
• Each user may maintain only one active account

3.3 Account Verification

We may require email verification, phone verification, photo verification, or identity verification before activating or maintaining your account. Refusal to complete verification may result in account limitations or termination.

4. User Conduct

4.1 Prohibited Activities

You agree NOT to use the Platform to:

• Harass, abuse, stalk, threaten, or intimidate any person
• Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Solicit money, passwords, or personal information from other users
• Engage in commercial activities without our express written consent
• Distribute spam, chain letters, or unsolicited communications
• Upload or transmit viruses, malware, or malicious code
• Interfere with or disrupt the Platform or servers
• Collect or store personal data about other users without consent
• Circumvent any security measures or access restrictions
• Use the Platform for any illegal purpose or in violation of any law

5.1 Prohibited Content

You may not upload, post, or transmit any content that:

• Contains nudity, sexual acts, or sexually explicit material
• Depicts violence, self-harm, or dangerous activities
• Promotes hate speech, discrimination, or harassment
• Contains illegal content or promotes illegal activities
• Infringes on intellectual property rights
• Contains private information of others without consent
• Is false, misleading, or constitutes misinformation
• Depicts minors in any context (absolutely prohibited)

5.2 Photo Requirements

• Photos must clearly show your face (no sunglasses, masks, or heavy filters)
• Photos must be current and accurately represent your appearance
• No group photos as primary images
• No commercial advertising or promotional material
• No contact information displayed in photos

5.3 Content Monitoring

We reserve the right to monitor, review, and remove any content at our sole discretion. We may use automated systems and human reviewers to screen content.

6. Safety & Reporting

6.1 User Reporting

You may report users who violate these Terms through the reporting features available on the Platform or by contacting our support team. We take all reports seriously and will investigate promptly.

6.2 Law Enforcement Cooperation

We cooperate fully with law enforcement agencies and will provide information as required by law or court order. We report suspected criminal activity, including but not limited to:

• Child exploitation or endangerment
• Sexual assault or harassment
• Fraud or financial crimes
• Stalking or threats of violence
• Distribution of illegal content

6.3 Background Checks

While we may implement safety features, we do not conduct criminal background checks on all users. You are solely responsible for your interactions with other users.

7. Privacy & Data Protection

7.1 Data Collection

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms.

7.2 Data Security

We implement reasonable security measures to protect your data. However, no internet transmission is completely secure, and we cannot guarantee absolute security.

7.3 Data Retention

We retain your information as long as your account is active or as needed to provide services. Upon account deletion, we will remove your profile information within 30 days, though some data may be retained for legal compliance or legitimate business purposes.

8. Termination

8.1 By You

You may delete your account at any time through your account settings or by contacting support. Upon deletion, your profile will be removed from public view.

8.2 By Us

We may suspend or terminate your account immediately, without notice, for:

• Violation of these Terms, including age requirements
• Fraudulent or illegal activity
• Harassment or abuse of other users
• Creation of multiple accounts
• Failure to comply with verification requests
• Extended periods of inactivity
• Any reason at our sole discretion

8.3 Effect of Termination

Upon termination:

• Your right to use the Platform ceases immediately
• All licenses and permissions granted to you terminate
• We may delete or retain your content at our discretion
• Provisions regarding liability, indemnification, and dispute resolution survive termination
• No refunds will be provided for terminated accounts

9. Limitation of Liability

9.1 Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

• Your use of the Platform is at your sole risk
• The Platform is provided on an "AS IS" and "AS AVAILABLE" basis
• We are not responsible for the conduct of any user on or off the Platform
• We do not guarantee the accuracy, completeness, or usefulness of any user content
• We make no warranties regarding compatibility with other users

9.2 Limitation of Damages

To the maximum extent permitted by law, Nairobi Elite and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Personal injury, emotional distress, or death resulting from Platform use
• Loss of profits, data, or goodwill
• Unauthorized access to or alteration of your transmissions or data
• Statements or conduct of any third party on the Platform
• Any other matter relating to the Platform

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform after changes constitutes acceptance of the modified Terms. We will notify users of material changes via email or Platform notification.
